OPERATING POLICIES

We offer an extensive selection of 14k discount gold jewelry, gold chain, necklaces, 14k gold bracelets, 14 karat gold earrings, 14k gold bangles, religious medals, zodiac pendants, diamond tennis bracelets, and other 14 karat gold jewelry.

Clients must acknowledge and agree to the following operating policies and terms prior to making their purchases.

A. PURCHASE PRICE GUARANTEE: We guarantee that any regularly offered item will not be sold at a substantial discount (greater than five-percent) below our listed sales price less our standard discounts for a minimum period of ninety days, or we will retroactively honor such discounts to all Clients purchasing the discounted items within the purchase price guarantee period.

B. PRIVACY STATEMENT: At no time will we sell or otherwise share Client information with other merchants, Clients, or third parties. Client information obtained by us is used solely to better understand our Client's needs and to improve or facilitate our own marketing efforts. We will also discontinue sending our own E-Mail messages or other promotional materials upon the Client's request.

C. CREDIT CARD PROTECTION: We will always use the latest state-of-the-art encription technology to protect our Clients against credit card fraud over the internet and will always use due diligence when processing their credit card information. Prior to honoring a credit card order, we verify each Client's bill to address and telephone number with his or her credit card record. If the name, address, and telephone number entered does not match the credit card record, we must decline the order. We also conduct random telephone checks to verify Client information. Clients are also reminded that they are protected by the Fair Credit Billing Act which effectively limits their liability for fraudulent use of their credit card to $50.00.

D-1. RETURNS, REFUNDS, and EXCHANGES (also see "Partial Order Restocking Fees"): Items from which our control tag has been removed or tampered with are non-returnable. Clients must call us within fourteen (14) days from the date the item is shipped. Refunds are limited to the purchase price paid less any shipping and handling charges or Client incurred telephone costs. Clients must obtain a return authorization number (RAN) on all items to be returned prior to shipment by calling us at 845-527-7980. All authorized returns must be accompanied by a copy of the original invoice and be returned in the original packaging. Returned items must also be in their original marketable condition, and be returned to us by U.S. mail insured for the purchase value at the Client's expense. Refunds are only payable to the original purchaser, no third party refunds will be authorized. Exchanges for items in marketable condition can be made, however the Client will incur all related shipping and handling costs. Any partial refunds resulting from an exchange are again payable only to the original purchaser. Special order items and pierced style earrings are guaranteed only as to advertised quality and workmanship, and are otherwise non-returnable. Items that have been damaged, engraved, resized, or otherwise altered are also non-returnable.

D-2. PARTIAL ORDER RESTOCKING FEES: Due to the nature of our pricing and cost structure, Clients who order mulitiple items of a similar style and size on the same order and who return one or more of those items will be charged a restocking fee of ten percent (10.0%) in addition to being responsible for all shipping and handling charges.

D-3. DIAMOND BRACELET RETURN POLICY: All diamond bracelet purchases are subject to a ten percent (10.0%) restocking charge, in the event that the item is returned for nonwarranty related reasons. Some special order bracelets may not be returnable except for warranty related issues (check with your customer sales representative).

E. AVAILABILITY OF ITEMS OFFERED: Due to the nature of our supply and inventory structure, all the items offered may not be available at all times. We will promptly notify Clients in the event that an ordered item is unavailable. Absolutely no substitutes will be made without the Client's prior approval.

F. 14 KARAT: All Gold items offered for sale are 14 karat yellow, white, or two-tone gold.

G. ITEM WEIGHTS: All item weights indicated on the weight and price charts are average weights per item. Actual item weights may vary slightly, and any corresponding price adjustment due will be made at the time of shipment to the nearest 1/10th of a gram.

H. PRICE CHART OR POSTED WEIGHT ERRORS: We make every effort to ensure that the posted weights and prices are correct. However, in the event of any discrepancies between the stated price per gram and the price posted on a price chart, the item's weight times the stated price per gram by price category (see "Pricing") will always be controlling.

I. QUANTITY RESTRICTIONS: We reserve the right to limit item quantities and total dollar amount purchased by any Client at any time.

J. ORDER VALIDATION and VERIFICATION: At our sole discretion, we may verbally verify any order or decline to fill an order for any reason.

K. INTERNATIONAL ORDERS: We are not accepting international orders at this time.

L. SHIPPING AND DELIVERY TIMES: Discount Gold Exchange assumes no further responsibility for deliveries to "in care of addresses" or offices once the shipment has been delivered to the authorized address by the selected carrier and signed for. Normal delivery time is two weeks and expedited delivery is usually seven days; however, Clients working with specific time deadlines should contact us at 800-634-0930 to be sure of delivery dates.

M. WARRANTY AND GUARANTEE: All items are individually inspected prior to shipment. We warrant all items to be of the workmanship, quality and grade advertised at the time of delivery. Client satisfaction with all items is unconditionally guaranteed for fourteen (14) days from the original shipping date (except for special order items and pierced earrings which are only guaranteed as to advertised quality and workmanship and are otherwise non-returnable, and restocking charges on diamond bracelets, see "Returns, Refunds, and Exchange" policy). The extent of our liability to the purchaser under any and all circumstances is limited to a refund of the purchase price paid for an item less any associated shipping, handling, or telephone charges incurred. Subsequent loss, damage, breakage, or discoloration of an item as a result of the Client's use or mishandling; improper cleaning or polishing; or exposure to soaps, cosmetics, perfume, hair spray, cleaners, household bleach, chlorinated water, etc., after delivery are not our responsibility and such items are not returnable.

N. TERMS AND CONDITIONS: The specified terms and conditions contained herein (materials presented on this website) represent the sole and entire agreement between us and the purchaser with respect to any and all transactions however generated, and supercede or replace any other representations express or implied. Clients agree that these terms and conditions shall be interpreted pursuant to laws of the State of New York (USA), and that the availability of this website in any other jurisdiction shall not be deemed as consent by us to the laws or courts of any other jurisdicition or be construed as an act of doing business in any other jurisdiction. At our sole discretion, we may modify these terms and conditions at any time without notice, such modifications having full force and effect when posted to this website.
